By the way Shirley, I got a call drom Dell Financial Services yesterday, and I thought it was funny that if I talked to them in a low, calm , monotone voice they got more upset than if I got upset and raised my voice.

Shirley,
Are you receiving the call from this number for the first time? If so, you will hear from them through a letter also. This might be possible that the company is trying to make a fresh contact with you regarding a new account.
If you come to know that the company is calling you for the account for which you have already sent the C&D letter, they are violating the laws. But if it is for a new account not relating to the previous one, then you will have to send a fresh C&D letter once again.
Do you remember any other account in the past for which the company is calling you? Or is it the same type of repeated calls for one particular account only?
Please update us a little bit on this matter.

Roxette

I got a letter from them on December 5 regarding the same reference number they left on the answering machine today. ( I checked it against the letter that I received from them where they had it listed) The day after I received their letter, I was up at the post office sending them off a validation request along with a 'do not call written correspondence only' paragraph. I received the green card on it at the end of last week. now they're calling. This is the first time they've called. They first mailed the letter, I responded right away.
okay, now I know they are breaking the law by calling after I told them not to, but are they also breaking the law in calling after I requested validation and they haven't provided it?
Oxford is doing this same thing. They call every day and I have started keeping a journal of the time each day that they call. I also asked them for validation, didn't send it properly the first time but they got it because they responded (they sent last six months of payment history)....so I sent out another one but certified return receipt this time. GOt the green card back but they have called me every day. nothing else in writing from them, just one phone call every day seven days a week.
thanks, shirley

As I have said in the other thread also, you need to retain an attorney and file charges on them. The collection agencies are breaking the laws so easily because they think that the consumers will not take any actions against them.
After you have sent the validation request to the company, it is their responsibility to give the necessary details. If they are unable to give it and still continue with the collection activities, it is a violation of the consumer protection afforded by the fdcpa Section 809 (b). So, in total, calling you after sending the C&D letter and then not giving you the validation details, the company has added to the number of violations of the law. Consult an attorney.
