Did you ever get a summons to appear in court? if you did notI I would call the courts where these papers are from and ask if the judgement is real. If the courts say it is then I would file a motion to vacate due to not being served. then go from there. So CALL THE COURT ASAP.

No I never received any summons to appear in court. Just the documents I have now from the prothonotary's office at the court house.

In the beginning of all of this I did have to pick up paperwork at the courthouse, I dont know if that counts as being served.

Call the court house and ask them if it is a real judgement. That might be concidered being served. Did the court papers (that you picked up) have a court date for you to apper?

No I was never given any date to appear in court. If there would have been a date, I would have showed up.

i went to the court house and basically they have a judgement against me for not paying even though they didnt bill me. Anyway it basically will prevent me financing anything.

Did you find out if it was a default judgement? Ask them how you were served and then you need to file a motion to vacate the judgement because you were NOT served.

well I asked about being served. She said by picking up the documents at the courthouse, I basically served myself. There was no courtdate. I asked if this was a legitimate judgement and she said I quote, " You're at the courthouse arent you?"

Do you still have the papers you picked up? If not call the court and ask them to get you a copy of them, you might have to pay a fee for them but you need to make sure tehre was no date to appear on them.

i did not know that picking up papers that had no court date was considered being served?

I did pick them up at the Sheriffs office clerks desk. Yeah I have them buried somewhere I believe, I'll have to check.

you can always call your sheriff's office for a copy of it if you need to :)
