The letter you have received from NCO financial systems INC is a collection letter and so you should immediately send a debt validation letter within 30 days (including holidays) from the date you have received the letter else it will be considered that you owe the debt as per the Fair Debt Collection Practices Act. You should always send DV letter by certified mail with return receipt just as a proof that you have asked for validation.

ok thank you..but I'm confused becauseI called and nco stated they are working with capital one and on the bottom of the letter it has capital one's address and says make payment to them.So do I still send a dv letter to this nco and also they had 3 different addresses on their letter and when I called them she gave me a different address.

This means that NCO has been authorized by Capital one to collect the debt. Since you have received a letter from NCO financial, you need to send the DV letter to NCO and not to Capital one. Can you please mention the addresses here so that I can check it out the address in which the DV letter has to be sent?

The last address is where the woman that I spoke to,from NCO, said to mail the letter and this address wasn't even in the letter but the other 3 addresses were. I don't get it...they said in the letter I could send a letter requesting validation and if I didn't they would assume the debt is valid etc. but yet they put 3 addresses in the letter.Anyway..appreciate your help.

Sounds what NCO is doing right now for Capital One is called and "early out". They are doing collections for directly for Cap One with the payment going directly to Cap One. You can send a DV but Cap One as we know likes to sue...so beware.

thanks for the advice soap lady..it has only been 2 1/2 months that we are behind on our bill..so was surprised to see it moved to nco already.Anyway....I'll keep you posted to let you know what the final outcome is..hopefully they will offer a settlement and not sue,but will send out this dv letter in the meantime.

You can send the debt validation letter to any of the above addresses mentioned on the collection notice within 30 days of receipt of the letter. Always send debt validation letter by certified mail with return receipt as a proof that you have requested for validation in case the CA later disagree. Most creditors transfer the debt to the collection agencies if you have not made a payment towards the debt for a continuous period of 90 days and after 180 days they generally charge off the debt.

Last night I read from a debt relief site that if you are afraid of being sued do not send a DV letter and just wait it out, do not make any contact with the CA and they will eventually pass it to another CA. Since it is such a short time the original creditor might still have records and can prove the debt.
I'm going through the same thing with capital one, soon with Chase and a credit union and just received a letter from NCO yesterday for Cap One.
This economy is making it impossible for me to make payments and eat at the same time.
