Write a letter to Van Ru Credit to return your check if they are not working on your account. Attach a note in the letter saying that if the company does not return the check and cashes it in the future, you might be forced to take strict actions against them. Give some legal importance to this statement. Keep the letter that you received from Van Ru Credit in safe place for this purpose.
Now, you will have to find if midland credit management is legally holding your account or not. It is the collection agency that will update your accounts as 'paid' with the bureaus. So, you will have to find out that your payments will be going to the right place. If possible, talk to your original creditor and see if they can give you any information about this account. They might help you in knowing the actual status of this account.
Further, you can contact Midland Credit Management at the following address and request for a debt validation of this account. Check your credit report and see the latest standing of this account. It might be possible that this account will now be reported under this company name.

Remember to do all your correspondences in writing. It is very important to cover your basis when you are dealing with any agency. Send your letters through certified mail with return receipt requested. You will be sure that the company has received your letter on the dates specified in the receipt.
I've had this happen to me and it has affected my credit. About
I've had this happen to me and it has affected my credit. About 6 years ago there was a Verizon bill that had gone to collections. I paid it in full, but somewhere between the time I sent the check out and the time it was received, my account was sold from one collection agency to another and the payment was never recorded. Long story short, I just got the Verizon account updated on two of my credit reports a few months ago. My advice, keep calling, even if you have to call the company who the bill is for and have them put you in touch with a collection agency. If it's the wrong one, they'll most likely have the number of who they sold it to. Keep up with it!!
Re: Ben's reply
Ben,
I've typed up a letter to Van Ru. Basically stating that I had sent out a check and Check# for the specified amount. Also I had received 3 statements from them that my acct. was transferred. I also stated that I would like my check to be returned and that if it is not returned and cashed in the future I will be forced to take legal action against them, since Van Ru is no longer involved with my account and should therefore not have access to my bank account. My question to you is, Is this sufficient and if need be, do I have a case against them? Thank you for your time.

You certainly have a case against Van Ru if they are not holding your account and cashing your check in the future. Responding to your letter, the company will present the accurate shape of this account at present. If they are still responsible to collect money from you, you will have a case against midland credit management.
Whomever you make the payment to, make sure that you have the details documented. You should be assured that your money will go towards your debt account and the agency will update it with the bureaus. It is better to get in writing from the company that your accounts will be updated with the bureaus after you have completed the payments. Keep a follow up on the phone as well.

Simple solution.. 1) place a stop payment on check, 2) sent Van Ru a certified letter stating that you have stopped payment.. explain why. 3) find address to Midland and send them a certified copy of the letter to Van Ru, also include a validation letter and state that if and when they provide proper validation, you will pay them what is owed.

This point is good but know the fact that it will add NSF charges and the debt amount will go higher. I just put in my 2 cents here.
Sent a certified letter to VanRu
Ok, I sent a certified letter to Van Ru on 1-11-06. This morning I'm checking my bank account and the check I sent back in Dec. has cleared. I printed a copy of the cleared check front and back. It looks like Van Ru cashed the check then turned it over to Midland. Now I still have not received written correspondence from either agency. Until then what can I do?

In my opinion, I think you should just sit tight and wait to hear from Midland. If they're the ones holding the account now, then you should be hearing something from them. JMO, shirley
