payday loans in missouri

can anyone tell me if these payday loans are legal in missouri?

i have already sent cease and desist letters to each one, and also notified them that i was revoking my ach agreement.
my bank refuses to close my account because it is over 1000.00 in the negative due to these charges and nsf fee's piling up. i had made a payment arrangement with cashnet usa for the 17th of april and they sent through another charge of 306.87 to my bank on the 13th. can they do this? now i more nsf fee's and have to work with the electric to keep from being disconnected tomorrow.
what can happen if i cannot keep a payment arrangement because of them still sending ach through my bank?
after reading some of these post's i see that i need to concentrate on the store front one's first, but at the same time what if i cannot keep a payment arrangement i have made with them at that time, but can at a later date?
i am not sure at this time how much i have paid on some of them.


Cricket, If I remember correctly these companies have to be licensed by your state to lend in your state...even online.

You need to get with your bank and even if they do not close the account atleast have them place a debit block on the account and not allow any debits to come through. They CAN do that. Sometimes they will argue with you but they CAN do it. Make them do it. This means you can not cash checks or use an ATM/Debit card but right now it does not matter. Also if you have direct deposit, you need to get it stopped so that you have control of your $$.


BIG and GFSIL are not going to be licensed anywhere...they are overseas.

And..From what I have read posted on other threads on the Site regarding MO and the pdls you listed, Cashnet USA and Check City are licensed as well. The ones that are licensed, you will need to work out payment plans with them

Of course Speedy cash and American payday will be licensed and you do need to work out payment plans with them. Both of these companies are members of CFSA which should help you work with them to get a payment plan. Members of CFSA will break up what you owe into 4 payments to get them paid off. Whatever you do...work with them. IF you want to understand more about CFSA, you can use the search box on the top right side of the page or you can google.

I have been on the phone with my bank and also went to the branch and they both tell me that the cannot put a hard block on my account. which means that i am still racking up nsf fee's on the account i am at a loss as to what to do. any other suggestions on how to handle my bank which is BOA?

Okay here is some help with BoA. They are really horrible for helping in these situations. Their customer service is beyond lacking.

Okay,first BoA can be hard to work with. Even if you close the account when the ACH hit they will open it back up.

You have to be clear that it is to close and not reopen.

Many posters here have had major problems with them. The only way that some were able to get help was to file a complaint. My best advice to you is to speak directly to a bank manager. Do not take no for an answer.

You have the legal right to revoke any ACH three days before it is due to post. Write up your letters to the illegal PDLs. You can find an example here. Scroll to the 13th post to find it. Change the information on the letter to reflect your information and state laws. The letter includes the ACH revocation and wage assignement revocation statements.

Take them to the bank with the federal law that states you can revoke the ACH. You can find that here under 3(c).

Tell the bank manager that you have been dealing with these illegal lenders and although you have sent them those letters they are still debiting your account illegally and you want it closed down to stop them. You want it frozen solid. No ACH withdrawls what so ever from any company.

Do not take no from an answer. Demand they close it. It is your right and if they don't you are going to report them. Be ready for them to deny your request and give you the run around. Stand your ground.

BoA are horrible when it comes to these things.

If you want to open a new account with them then that is your right but I suggest you find a new bank.

After the account is frozen/closed then send out the letters to the PDLs.

If you send the letter before your account is closed they will debt many times each and for all kinds of amounts.

For the legal lenders. Once you account is secure you can make payment arrangments with them.

For the illegal lenders you only owe what you borrowed. Any fees or rollover charges go toward that amount.

I have been trying to deal with boa for over a month now on my negative account which keeps adding up more each week with nsf fee's from the illegal companies even revoking the ach's has not stopped them. no one ill do anything to help me at any of the branch levels or on the phone either. does anyone else have any suggestions

Did you follow the steps I laid out?

If so then file a complaint. You can do that here.

Get the complaint number and return to the bank and demand they close the account. Tell them you have filed and you are going to complain to everyone you can.

ACH Revocation is your right as the federal law states that I linked to. If you gave that information to BoA and they are still allowing the ACH then they are breaking federal law!

I hate BoA and I never had an account with them. Uggg They are the worst! :evil:
