If it is not a joint account then the answer is no, they can't take his wages. the only way I would even think they possible could is if they brought in receipts with his signature but even then I am not sure. Also, do you live in a community property state?
They can go after any assets in your name and freeze bank accounts with your name in them if a judgement is granted and you fail to meet the payment plan the judge sets.
You may want to contact a lawyer on what you should do next since you haven't yet received the summons yet.
