You can get the address of the agency and send them a CEASE COMMUNICATION letter, certified mail and return receipt requested. After they receive the letter they must by Federal Law stop contacting you. If they continue to harrass you, keep accurate records, report them to the FTC and your State Attorney General's Office. This will give you the proof you need to proceed legally against them. This kind of abuse should not be tolerated and should be reported to the authorities. I wish you the best of luck!

I am going to send a cease letter, but I have a feeling it won't work. We have already told them to quit calling any number except ours...instead they still call my husband's family daily...knowing that we do not live there, and they have our phone number, but don't call it. We have spoke to them once on the phone, other than that they call family members.

Cease and desist letter has a legal importance and the collection agency must follow the law after they have received your letter.
A collection agency is allowed to contact some other person only for the reason to locate you. Since they already have your contact info, they should be stopped from calling your in-law's place.
Please tell your in-laws to keep a record of the calls with the dates and time along with the name of the collector. If recording of the phone call is permissible in your state, you don't have to inform the caller that the calls are getting recorded. If it is not permissible as per the state laws, you have to inform him before you actually start recording the call. Make sure that your notification about the call being recorded is there in the recording, otherwise, your in-laws might face up legal troubles.
After you have sent the cease and desist letter, the collector is required to stop contacting you except to notify of any specific actions against you. Mention in your letter that you prefer to be contacted only by mail so that you can still be informed of the further actions.
The collection agencies don't want to face a lawsuit and they won't give any importance until you exercise your legal powers. Samples of cease and desist letter are available in this forum. You can modify it to your requirements and send it to their mailing address through certified mail with return receipt requested.

Any creditor or collection agency should not threaten the consumer with criminal prosecution. The Fair Debt Collection Practices Act states many other laws that are strictly applicable on them. Please know your rights summarized in the FTC's FDCPA link. It will help you in dealing with the collection agencies without fear and without getting intimidated.
If a collection agency involves in any of the violation of the stated laws, you have the federal powers to sue them. You will also be awarded a judgment plus reimbursement of your attorney fees. For more information, contact the consumer protection office in your area or consult an attorney. You will get aware of the legal procedures.

Ok ASG would never tell you they are going to take your house....its not harrassing your family if you do not return clls how is it known if the number in their system is correct???
you have to make sure u listen to what is being said and that you arent taking things out of context...do you remember the name of the collector you spoke.speak to?

As I said in my first post ASG DID say they would come and take my house...and I DID call them several times, and they DID keep calling my in-laws. I believe the person I spoke to was Chris, can't remember the last name..have it in my paperwork. How can I take that out of context? Those words came out of his mouth. I sent all of it to an attorney anyways, but thanks for inquiring.

The number to Texas lawyer is 1-800-670-9989. I guess explain to them the situation. The collection agencies aren't suppose to be threatening you or anyone from your families. That's wrong and against the law.

collector harrassment
i was a collector for 13 years. they call it account management. every tyme you tell them that the person they called does not live there and take my number off your call list. and they don't. they call from offshore exchanges and they get away with it. i never had a debt with them and have a perfect credit rating. People like ASG and Red Line and other collection agencys can't continue to practice this harassment. i contacted my Attorney General's office and have registered complaints i have sent them certified mail because i was told to by a lawyer. the would not respond to it. according to the "Fair Debt Collection Act" they have to identify themselfs and let you know that this an attemp to collect a debt. as i know when i look at my caller id it's them again and tell them the same thing. the area codes are not listed like 716 ,954 or even use your local area code. but mostly its "Unavailable" no matter who you complain to the creditor will just change colection agency that practice the same illeagal activity.
