GC Services - Is this validation?

I received a dunning letter from GC Services about a month ago. The had the AMEX account number correct but wrong name and account balance. I sent a validation letter to both their MO and TX office since they were both listed on the letter. I live in TX and here you have to be clear who is collecting. Anyway, I received my green cards back but so far no validation. They still have another week to reply. Today, I get another letter from GCS stating that their client is willing to settle for 65% of the balance and if I accept to send a money order to their office. Are they considering this validation? Or is this just an attempt to get commission before the end of the month? I'm thinking of sending them a letter back stating that they have not validated their claim and that I will send AMEX a settlement offer.


THAT is considered continued collection and a clear violation. It is in no way shape or form validation. Validation needs to be from the original creditor. You are in Texas, did you cite the Texas debt collection laws? They have 30 days to validate and they cannot continue to collect (which they have done) you could sue them right now and win hands down. Plus if you added the written notice in your letter, you could sue them for 3x the amount!

Texas is a great place to send DV letters.

Goldenbast, yes I did. I cited both the federal and Texas debt collection laws. I figured this wasn't validation but since I consider myself still a newbie, I thought I'd better ask. I might send them a counter offer letter and include the fact that they have violated the statutes. AMEX has been so hard to work with and I need all the leverade I can get.
