You really need to get in touch with Checksmart to let them know what your situation is, otherwise they can and WILL assume the worst. Stay pro-active, don't ignore it because if you do they can and will sue you. My suggestion would be to call the corporate office and ask to speak with the Manager, explain your situation. By the way, Ohio is a two party state which means you can record the conversation you are having without their permission, just in case they decide not to follow through with any agreement you make on the phone.

This does not sound like a payday loan. This sounds like one of the new loans they are making under the small loan act. It was their way of getting around the new payday loan laws in Ohio.

Here is a recent article about it.

They can not get fraud charges on you. They can take you to civil court though and get a judgement to garnish your paycheck.

I also have one of those short term loans from Checksmart (or whatever they are calling them now:O) I also live in Ohio. I noticed that Sharriss , original poster on this thread, paid $60 fee for $400 loan. I borrowed $865 from checksmart and paid $912.50 which is only $50 fee - I wonder why the small loans seem to be different amounts for different people. I noticed this at Check Into Cash as well. I borrowed $600 and paid back $637.00 whereas someone else came in for $600 right next to me and they were charged twice the fee. Just curious if anyone else has noticed this in Ohio. Sharrisaragland, I have defaulted on Checksmart more than once and they will work with you if you just stay in contact with their corporate office. I had a check bounce on 4/6 and I told them I would be in 4/17. I wasn't able to pay 4/17 so I called them and got another week extension. Just be honest and they will work with you. I had one at Cashland also that defaulted and they gave me almost 2 months to pay them back....hope this helps!
