Upon reading literally hundreds of articles and blogs regarding fair credit reporting practices, I have yet to find anything that tells me exactly what the bureaus are allowed to legally report after a bankruptcy. I want to make sure everything is being reported correctly but there are items which I feel are misleading and not 100% accurate but when I disputed these items, they came back as verified and meeting FCRA requirements. For example, I had my home included in the BK which was of course reported as a foreclosure. However, I have 2 entries reporting the foreclosure, 1 from Saxon Mortgage and the other from National City. They are identical other than the DLA's which are about 3 months apart. Another example is accounts included in the bankruptcy having a status as Derogatory. I know both of these issues are bringing my score down but do not know how to challenge then so that they are reported properly.


I think the best thing you can do in your situation is to add a note to the separate entries on your credit report, stating that you disagree with the way it's being reported, and that it was included in a Bankruptcy - and give the date it was discharged. Any creditor who pulls your credit will see those notes.

If you truly feel the creditor is reporting in error, perhaps it's time to contact the creditor themselves and provide them with the documentation that proves their debt was included in the bankruptcy that you filed, and request that they report it accurately.

i had filed bankruptcy 8 years ago..after which, all my negs stayed as negs on cr..BUT they had to say included in bk in them..sorry to say they will fall off after 7 years appoximately just like other entries according to FCRA. your bankruptcy itself depending on what type you filed maybe reported for upto 10 itself which really sucks..you always have the option to add a consumer statement to your cr entries..hope this helps..i couldn't get them off either! Let me know if you do..
