credit card issue

My husband was served by CCSD & hew called the law firm on paper work to find out what this was about. Who ever took this cc out in my husbands name had the WRONG date of BIRTH & WRONG social security number said Pedro J Zabala himself or office... My husband tried to explain that he never got a court notice and to find out the notice was taken to his mothers and they don't speak so there you have it... we were NEVER informed of this paperwork then the legal action came about only to find out that someone put a credit card in my husbands name and this Pedro J. Zabala doesn't even care...as long as they collect the money.... so my husband and I pay on this since feb 2008 we miss ONE payment in nov 2009 they reserve us april 2009 for more money or they will come take our stuff!!! My husband lost his job I'm the only income we have three children and they want to take away our things for a charge card that we didn't even have....


Wait a sec.. if this isn't your husbands credit card why didn't you send a debt validation letter to the attorenyand let it go to court, file idenity theft with the police etc? If this wasn't my card, I wouldn't be paying a dime on it.

And if you did get a judgement, when you learned that it wasn't yours file a motion with the courts to vicate the judgement as to improper service not to mention it's not yours?

1) Obtain current copies of your credit report.
2) Contact the police and file an identity theft report.
3) Fax or Mail copies of the report to any unidentified creditors on your credit report.

You are going to run into a few problems because you have made paments but you need to start this process. Question? This summons that was supposedly sent to the mothers home, does anyone there remeber sigining for it? You're going to run into problems there because they should have just said that your husband doesn't live there and not signed for anything.

Start clearing these matters quickly and be sure to keep all your paperwork because you may have to see a judge.
