No Declaration from Plaintiff: Dismissal?

I have an appearance in two days against Unifund. The judge told me each party has to submit a Declaration 15 days before the appearance. I have received nothing from the plaintiff. If they show, can I ask the judge for a dismissal?

Did you and your collection agency ask the court for dismissal of the case? If it is so, both the parties, must submit a separate declaration within the date mentioned, and once you pay the amount to the creditor, the case is automatically dismissed.
