pdl nightmare begins

Today I received my first two phone calls. I received one at work this morning from the collection agency for National Opportunities Unlimited and the other was left on my answering machine from United Cash Loans. The person at nou It'syourpayday,.com said that my payday did not go through and that my bank account was closed. She also said that I need to give them another way to make a payment I told her that I would email them today. The message on my answering machine said that I need to get in contact with the caller who left no name at Unitedcashloans.com at 1-800-354-0602, ext. 2024 by 4:15 central time or further action will be taken. She was already threaten me before she even spoke to me. That is two down and eight more to go. I am getting kind of nervous and anxious. Should I be too worried. I should send a letter to my job I guess. what should tell my co-workers when I start receiving these calls.

You will definately need to tell your boss and your co-workers something--because you will probably be getting alot of calls and some of them might get alittle crazy. I told my boss and co-workers that my bank account was being drafted for money that I didn't owe. (kinda like mistaken identity or even identity theft.) I told my boss and co-workers that was the reason I had to close down my checking account. I also told them that I had talked to the Mississippi Dept. of banking and consumer finance (and I did contact them to make sure that all my internet loans were illegal in my state--and they all were! The man at the dept. of finance told me not to pay any of these companies a dime!) When all the calls started coming at work I would answer the call but I would politely tell these companies that I would only communicate with them in writing and then I would hang up. One company called me about 6 times within 10 minutes saying all kind of threatening things. I just would say please send me this information in writing and then I would hang up. These calls lasted about 2 weeks. I have not heard anything from any of these companies in 2 months. It just helped that my boss and co-workers had an explanation when the calls started--so I wasn't humiliated at work. That is what these scumbag illegal companies intend to do. They are trying to make you uncomfortable at work so that you will do anything to make the calls stop. They are illegal and no matter what they say thay can not do anything to you.

Thank you so very much for the response it can be very embarrassing to get the phone calls at work. I will try to answer the phone calls myself as much as I can, but just in case I would like to tell my co-workers something. Thanks for the advice.

I finally got my letters out. Now all I have to do is sit and wait for the responses. I think I am ready for the fight. I just need to contact the AG, my job, the BBB, and the FTC and call for information on the banking laws.

I HAVE PAID THE LOAN AMOUNTS THAT THEY WANT BUT CANT SEEM TO GET THE PAPERWORK TO THAT STATES THEY HAVE DISMISSED ALL CHARGES OR COURT DATES YET THAT THEY SAY THEY HAVE. SUPPOSITIVELY I AM SUPPOST TO RECIEVE ALL THAT INFORMATION WITHIN 7 DAYS. THEY WANT ME TO TAKE THEIR WORD AND I AM NOT WHICH THEY ARE GETTING VERY HOSTILE ON THE PHONE BUT TO ME THIS IS A BIG ISSUE AND I WANT TO MAKE SURE IT IS RESOLVED PROPERLY.

Reason being is many of us have dealt with these lenders in the past and are offering information and advice on how to deal with them based on experience. Many of us have done research and have alot of knowledge on how to handle them. To find out the Legality of these lenders, you can simply check with your state's Dept of Financial Institutions. We often do and give you the information based on our findings. Hope that helped :wink:

When I shut down my checking account I started recieving calls but I didn't answer unless I knew the number was a work related number. Almost two weeks after I sent my letters out they stopped calling me at work. I also changed my home and cell phone number to basically force them to contact me in writing.

That means a couple things.

First you should close your bank account. Once they have access they AWAYS have access.

Second it means you only owe them what you borrowed. Any fees or rollover charges are applied to that amount.

i.e. If you borrowed $300 you only owe them $300.

They will threaten and harrass all types of things but they can not legally do anything since they made a loan to a consumer in a state that requires them to have a license, which they do not have.

Correct.

If they threatened you with jail, criminal or arrest charges they were lying. They are most likely illegal as legit companies do not threaten those things as it is illegal to do so.

Again, debt is civil not criminal.

The most a legal company can do is file a case in civil court and get a judgement to garnish wages.

No one can be arrested for a debt.

I feel bad what has happened to you but a lot of us have been there and been intimidated by these types of people.

We all live and learn. It has happened to many of us. :(
