Pay Day One

I sent payday one a request for their license to operate in the state of Kentucky. I received a response from their legal department stating that they were licensed in Delaware and that the contract I signed made me liable for the charges. I responded that I knew they were operating illegally within Kentucky and that I had $200 left to pay to cover the principal balance as well as Kentucky fees - they will not accept this offer. What is my next step?


I used to have a loan with Payday one as well and am from KY. I overpaid them big time (over $1000). They wouldn't agree to mark my account PIF even after I forwarded all the info. from the KY DFI office. I get an email every now and them offering me to drop all the fees and me pay the principle they say I owe...$1000. I just keep resending them the email asking for a PIF. Don't stress over them. They can't sue you over it in KY. They are operating illegally! I would close your bank account and then send them the revocation letter and attempt to pay them the remaining principle from the original loan (only if you owe them any...don't forget to include any "fees" they may have illegally charged you).

Payday One is very persistent, I wouldn't allow what they say to get to you, just state the facts to them repeatedly via email, send them what you owe and be done with them. They are fully aware of their error but most likely will never admit to it. I do hope you will file a complaint against them with the FTC and the BBB, they deserve to have a black mark if they aren't going to abide by the law.

So the KDFI is still looking into this loan. I received an email from them today telling me it looked like Pay Day One is now issuing these loans as installment loans not payday loans. They are checking with their legal department. I'll post when I get a final answer

Today, I received a phone call from someone wanting to make me aware of an affidavit (sp?). He wanted my attorney's information as PayDay One is going to file suit against me for the unpaid balance. Still haven't heard from the Kentucky Attorney General's office. Should I make payment arrangements or hold out?
