question dealing with licensed internet pdl

I don't want to put to much info in case they are reading here. Anyway my state is one of those that allows pdl if they are licensed in any US state. So one that I am trying to deal with is licensed (but does lots of illegal stuff as well). I sent an email a week before my due date revoking ach and requesting a payment plan. They sent me an email back saying to call in to dicuss it. But they went ahead and sent the ACH thru anyway! Fortunately my account is closed. I really don't want to talk with them on the phone now that they have proved themselves untrustworthy and would prefer to keep it all in writing. Is that okay to do or should I call?


okay...I need a little more advice please. I am talking about LoanPointUSA/GenevaRoth here. I have seen lots of contridicting info posted about them here from they are licensed, to they are not, to thier license expired, to there is a Geneva Roth Licensed but it is not them. There is a Geneva Roth licensed but how would I know if its the same one? I notified them 5 business days before my due date that my bank account was closed and that I revoke ACH priveleges and I wanted to make alternative payment arrangements.

I have from them in writing, after I sent 2 seperate emails revoking ach and telling them my account was closed, that they were going to continue to debit my account and I would continue to rack up fees for returned items even though they know my account is closed. The only form of payment they will except is thru my checking account so I better go open up another one! LOL Sure, whatever you say! I guess they don't want thier money too bad then.

How do I even begin to deal with this from a legal pdl? I am going to report them to the BBB, AG & DFI. I am not sure if I should have anymore correspondence with them or not.

This is for a very small principal amount, actually the smallest one I have to deal with and have paid well over the principal amount back to them already. I have no problem paying the principal plus the interest that was owed as of the day that I first sent them the letter revoking ach and asking for alternative arrangements, but I am not willing to pay all this extra junk they want to add on.

It looks to me like frogpatch went thru something similar with them and I am going to do some more research as well. Any ideas?

I think the only state they are licensed in is Utah but they do pull illegal tactics all the time. They also loan to people in states where they have no license and they are required to have one.

They also use several different names and have PO boxes in several states that they are not licensed in.


To be quite honest after the pulled that stunt I would consider them illegal and treat them as such. I doubt they are going to run to your state and file a civil suit.
