Harrassing Phone Call At Work

I just had a harassing telephone call from someone who said they were with a legal team. They would not tell me the amount of the debt nor the company. They read a list of charges and made me into a horrible criminal. they said they would be here tomorrow to get me from work or home to go to court at 11:00 AM and that I should be prepared to pay $10,000.00. They said if I valued my life I would have my attorney contact them. I was in shock. He had a foreign accent and the number on work telephone was from out of the country. I took down the telephone number and went up to see the HR lady. I was just in tears. She called the number back and was very firm with them. The guy called himself Joe Brown, but when they transferred HR to "Joe Brown" it wasn't the same man. She said that what they are doing is totally illegal. They gave us each different addresses. What are my rights? What do I do? Any help would be greatly appreciated! Thank you! Jenny-Linn

First off, please don't be worried about any of the threats they made. The FDCPA (Fair Debt Collection Practices Act) is a law that protects consumers against just such collection tactics.

They aren't allowed to make any threats they aren't prepared to follow up on - like suing you for the debt. And they're not going to come to your work to get you.

This sounds very much like the tactics used by some of the illegal payday lenders - do you have outstanding payday loans now, or have you ever, in the past? There are a couple of illegal lenders out there that routinely call old clients - even people who haven't borrowed from them for over a year or two years - and try to convince them that they owe thousands of dollars for a debt of $200 that wasn't completely paid off.

Don't let them trick you into giving out any information - like your bank account info. They'll bleed you dry if you do. If this is an old PDL company, they have your social security number because you gave it to them at some point.

You did the right thing in going to the HR office to get this taken care of. Keep your HR person after them - don't let them rattle you. They will eventually give up. But be prepared for a slew of phone calls before they do. They're hoping to get someone - anyone - to pay them some money. They may even go so far as to ask your HR person to pay it!

I believe it is Kingston Financial from the UK who is behind the harassing telephone calls. I took out a payday loan of $200.00 and they took two payments of $89.00 but then I had to call them because I had to close my checking account due to fraudulant activity. I set up a pay day plan with them, but apparently they have grown impatient. I am just assuming that this is the company.

Should I get an attorney?

Where do I go to see what payday loan companies are illegal? I live in the state of Utah. And what do I need to state in my letter that I provide to my payroll at work regarding not allowing someone to take from my paycheck? I read it on another post in the forums. Thank you! Thank you for all your help. I have gotten into the vicious cycle of payday loans due to a car accident that wasn't my fault and my ex-husband deciding not to pay child support. I am at the point of going into bankruptcy.

Kingston is illegal and in the UK.

Utah license database.

The letter to payroll is a wage revocation statement.

It is just a basic statement.

Here is the link to the letter to send to the illegal PDL. Scroll to the 13th post to find it. In the letter is the wage revocation statement.

Just change it to reflect your info.

With illegal lenders you only owe what you borrowed. If you borrowed $200 and you paid back $89 X2 then you only owe them $22.

If the companies I have loans with are not on the Utah License Database then are they illegal?

I have included the following payday loans I have:

I have spoken to a gentleman at the Department of Financial Institutions and he wants me to prepare letters for all the internet payday loan that are not licensed in Utah. He wants me to mail them to him and then he is going to send them a letter or contact them.

Has anyone else worked with their state's department of financial institutions?
