Biggest-Cash.com = Biggest Nightmare (I need your help!)
Date: Wed, 05/06/2009 - 21:31
The loan was taken out on 10/31/2008 was for $400.
Payments were as follows:
11/20/08 - $120 - leaving my account at a negative 116.95. Payday/Direct Deposit was on 11/21/08.
12/03/08 - $120 - leaving my account at a negative 107.55
Payday/Direct Deposit was on 12/04/08 (notice a pattern?)
Then I started getting into trouble... Rent was due, overdrawn...
12/18/08 - $120 - Overdrawn over $300 at that point, so it returned.
12/24/08 - $120 They hit me again and it cleared, but all 8 of my other transactions bounced because of it. Lots of overdraft fees.
12/24/08 - $10 returne "check" fee
12/31/08 - $120 attempt - Overdrawn into the $500's at this point, returned.
1/07/09, 1/15/09, 1/22/09, 1/29/09 - $120's and $50 attempts - Overdrawn into the $700's at this point. Returned.
No Activity in February, merely because I stopped my direct deposit at that point because it was only covering overdraft after overdraft and I was unable to feed myself for a few months.
End of February and my income taxes just about covered the $900 in overdraft fees.
They leave me alone until March....then....
3/26/09 - Red River starts deducting $725 out of my account. Luckily I was only keeping about $100 tops in there.
4/9/09 - Red River tries again $725.
I am currently overdrawn only $100.
Then the phone calls start. They don't call me because I don't answer "Unavailable" numbers. They call one of my "references" who happens to be a highschool friend and leaves a message on her voice mail that I committed fraud and her name is involved in the lawsuit. They leave a number and a file # to call back with.
I called them back during the daytime and got a man with a strong accent. I tape recorded the entire conversation. He told me he worked for a "law firm" and was handling the case. Funny because (213) 784-4844 is not listed anywhere as a law firm. They didn't answer with a firm name, just a "hello?"
I got on tape, this man telling me I had to pay by Friday or they were going to proceed with legal action. I told him I needed a debt validation letter, and he didn't seem to understand what that was. I asked him several times if he was from a real law firm and he said yes. Funny, for someone who is a "lawyer," he did not seem to know the law as far as the FAIR DEBT COLLECTION ACT states :)
I repeatedly told him "this conversation is being recorded, and it will be used against you." At one point in the call he told me "You do not have to pay back this debt" after I stated that I would like a validation letter and to make payment through USPS Money order only. He claimed I can only make it through credit card.
Anyhow, that's my story. I live in New Jersey where we're supposedly not allowed to get these things. Bank of America has been the worst at helping me close down my account and since I have bad feedback on Chexsystems, nobody else will give me an account. I really don't like those prepaid debit cards and having to pay fees to put money on them when I have very little money (I work for a non profit organization.)
I got some of the letters that you guys posted on here and plan to use them accordingly. I never got a mailing address for Biggest-Cash.com and the emails they send me have spoofed email addresses to begin with.
Principle - $400
Paid - $ 360
I only owe these scammers $40 principle. They overdrew me about $2000 total in bank charges in the course of 3 months. Any advice will be appreciated.

PDLs are illegal in your state and Red River does not have a license anywhere.
BoA is horrible.
Even if you close the account when the ACH hit they will open it back up.
You have to be clear that it is to close and not reopen.
Many posters here have had major problems with them. The only way that some were able to get help was to file a complaint. My best advice to you is to speak directly to a bank manager. Do not take no for an answer.
You have the legal right to revoke any ACH three days before it is due to post. Write up letter to the illegal PDL. You can find an example here. Scroll to the 13th post to find it. Change the information on the letter to reflect your information and state laws. The letter includes the ACH revocation and wage assignement revocation statements.
Take them to the bank with the federal law that states you can revoke the ACH. You can find that here under 3(c).
Tell the bank manager that you have been dealing with this illegal lender and although you have sent them that letter they are still debiting your account illegally and you want it closed down to stop them. You want it frozen solid. No ACH withdrawls what so ever from any company.
Do not take no for an answer. Demand they close it. It is your right and if they don't you are going to report them. Be ready for them to deny your request and give you the run around. Stand your ground.
If you want to open a new account with them then that is your right but I suggest you find a new bank.

I'm sorry to tell you this, but there is only one sure way to stop the withdrawals, and that is to close your account. If that isn't an option, then tell the bank to put a hard debit block on your account. Before you close your account, read this information at the link below. http://www.debtconsolidationcare.com/paydayloan/close-account.html
Please do not let any of these pdl's know you are going to close your account, until AFTER you have done it!
