Got a call the other night from SRS & Associates, telling me I had till Friday to resolve the issue with their client, Total LEnding, or legal action would be taken against me. Told him I was in the process of dealing with Total LEnding for my principal balance only and that since they were doing business illegally in the state of Florida, I would not discuss this any further with him or his company. He told me they would garnish my wages, I told him they could not do that and he paused for almoast a minute, then said "correct, wage garnishment by these companies is prohibited in your state"... then I told him I was forwarding his name along with the other info I had to the SAG office and he hung up...

Spoke with one of the folks in the BOA Executive Offices yesterday. He was mostly nhelpful and very nice. Ended up refunding me almost $1000 in fees on my account, but told me they couldnt put a hold on my account because no fraud had taken place and they couldnt close the account because there had been previous transactions with these companies and they were debiting legally from my account. Told me I could TRY to go in and talk to the branch manager, which hasnt worked so far, and see what they could do, but the refund was already above and beyond what they would normally do in these cases.


Ugh...


They told me that since the account has been negative for so long, that there isnt actually any debits being made from it or fees added anymore, but if the companies continue to try to debit from it, they cant close it or put any hold on it... I was really confused by what he was saying, as he made it sound like they could opnly do that for fraud cases but not ACH debits like this...then told me to go back to the branch... im losin it here...lol

As nohiogal, said you have a legal right to revoke their ACH. Simply draft a letter stating that you revoke any and all ACH rights. Do this *TODAY*. Give a copy to Total Lending and give a copy to Bofa, in fact stop by a branch and talk to the branch manager, not some Customer service Associate. Give them the letter. By law they have to honnor it. In fact if you have more then 1 PDL, revoke all their ACh's and give each individual one to Bofa when you go in and talk to the branch manager.

If Bofa tries to draft any more of your pdl's after you've given them the letter, they are violating the law.

If Bofa continues not to work with you, file a complaint with OCC, and your states DFI. If you have confirmation from your DFI stating that your PDL's are illegal take those in when you talk to the branch manager.
