Hey All,

Just received a call from these "people" and they left a voicemail on my cell phone. They were looking for someone that I never heard of. The whole voicemail consisted of repeating "by remaining on the line you acknowledge that your are Theresa ???. If this is not Theresa ??? please hang up now. This is an attempt to collect a debt." Or at least words to that effect. I am not planning on answering because it is still my cell. Would it be worth blocking the Caller ID on my voip and calling them, or should I just ignore them until they go away. They do not know who I am, and they have no business with me. Good thing, because I have enough of my own collection problems due to the economy.

Also curious if this is a violation because they are announcing they they are trying to collect a debt without verifying the identity of the person they are calling. I was thinking of calling them back (with cid blocked of course), and telling them that they are in violation to try to get them to stop calling. It is a per minute cell phone that is only for emegencies, and I really do not want to use up my minutes for them.

Thanks for listening and letting me rant.


1) Even if it was your debt, they cannot cause you to incur phone charges (i.e. no collect calls, and no calling cell phones)
2) Save that recording, it could make you $1000. They cannot mention anything about debt until and unless they verify that they are speaking with the debtor. Only.

File a complaint with the FTC, the FCC, and your State Attorney General's office.

The message left on answering machines by collectors is called the "Foti" message and was named after the lawyer that came up with it. It is SOP for collectors to leave this message and is perfectly legal to do so. Advice is to call the agency leaving the message and let them know that they have reached the wrong party, and, to delete your number from their files. Deletion usually takes 24hrs for the systems to update. If you continue to receive these calls, then contact an attorney specializing in dealing with illegal collections and harassment.

They weren't talking about a listed home phone, they were talking about a *cell phone*. The Foti message is more relevant to 1st contact and the FDCPA definition of "communication".

And it's really a moot point anyway, this person needed to find out who was calling and send them a Cease & Desist letter...
