I live in PA and i have taken 2 pdl 's one from The DJR Group LLC and the other is Ashlund Funding. I have so far not paid anything back at all on either loan. First are these companies illegial? If they dont get there money out of my bank account what can they do? Can they garnish my paycheck or press charges against me. i will pay back the loan but i will have to either pay by money order or western union since my account is already overdrawn and i cant afford to bring it to a positive balence. How should i handle this?

hello, welcome :) i know PA changed their laws and i am not familiar with the new ones but someone will be around soon to help with that :)
my first step is to secure your bank account.. there is a sticky here to read about things to watch out for. but even putting a hard block on your account will prevent it from being even more overdrawn.
i do not know pa laws on wage garnishments but am pretty sure i heard that it cannot be done there? again i am sure someone will be around to help more. :)

They cannot garnish your wages without a court order. What they can attempt is a "wage assignment" This is a voluntary document that allows them to try an attempt to deduct the loan amount form your wages. This is voluntary and can be revoked at any time. They also cannot press charges against you or have you arrested. A debt is a civil matter not a criminal offense.

You stated that you paid nothing towards to loans as of yet. Did you close your bank account or are the due dates in the near future.

Please read HERE to learn more information in dealing with illegal lenders.

Here is a copy of the wage assignment revoke letter. you will need to send this to your payroll dept and the PDLs.

Quote:

Date:

Name Of PDL

Your Name
City, State
Account #

I hereby revoke any and all wage assignments I may or may not have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected.
