I need some help, please.....

Today, a process server came to my home. My TV was on and loud, also the window was slightly open, so when on the front porch...you could definitely hear the TV.

This person was trying to serve paperwork to my husband. I muted the TV, which was obvious (stupid me), and did NOT go to the door. The blinds were closed, so there was NO WAY for anyone to see into my home.

The process server pounded on the door for a long time. Then, stood patiently waiting for someone to open the door. This person was at my front door for OVER 10 minutes, constantly trying to get someone to answer. Finally, the person called out the FIRST NAME ONLY of my husband, for whom the papers were drawn. NO ONE said anything..... This person pounded again on the door, with NO ANSWER.....A third time, the pounding on the door resulted in the process server saying loudly through the window..."David, I'm leaving some paperwork for you at the front door". Then, the person went back to their vehicle and drove away.

This account was a bank debt from approximately six years ago. It was incurred by my husband before we were married. We live in Colorado, and want to know what the statute of limitations on this particular situation. Also, is the manner in which the court document/summons delivered considered acceptable? The process server did NOT speak, nor did they SEE anyone present. What if we had been out of town? The date on the paperwork is April 10th. Today is May 9th. Does a summons "expire" in 30 days...if not delivered???


You might want to check your statute of limitations in your state. Othwise, I'm not sure how to answer this but I wanted to acknowledge your post and bump it, please keep checking back for replies. The weekends are usually a bit slow so hang in there, someone will answer this when possible.

I would suggest you check your state or county laws on how you are supposed to be served. It could be that if the processon believed that you were in the residence avoiding contact then they may have had the right to leave it at the door.

I would reply to the summons if it is requested because a default judgement is not something your husband or you will be happy about.

Hopefully someone will come along and be able to give you more information.
