Hi I will be signing my paper work next week then waiting for my hearing. Is it common practice for a bank (bofamerica) to make false statements about my account to try and get us to settle on a amount??? There is no truth to any of it and my statements prove this. My attorney feels they are just trying to blow smoke up my butt to get me to settle. What bothers me I am so upset with this whole thing to begin with and really feel like a failure to myself my family that I have to go this route. And then to have them bank of america accuse me of wrong doing. Just wondering if this has happened to other's?? Thank you to this forum for being here it truly is a comfort to see I am not alone. Hi they said the balance was charged in the last 6 months not true the account opened up in 2005 and my 2007 statement had the balance already on it. They said I had not made a payment in 13 months not true never had a late payment until my attorney advised me not to make any more payments this was 10/08. They stated I showed them a w2 6 months ago to reinstate the account with a huge amount that I do not even make but my 2008 taxes will prove this also. The funny thing is this is a credit card why and how would you reinstate it? Not one thing was true or made any sence. But my attorney said if they have all this concrete evidence why would they settle for .10 cents on a dollar... makes you wonder the games they play.
