I have had real problems with Nationwide Cash out of Claymont, DE. I have over paid them $250.00 and argued with them (because they called me and gave me 48 hours to respond) regarding Indiana law. They said they "DO NOT" abide by Indiana Laws. I've sent the cease and desist letter with my offer of settlement which someone signed for. They said since I'm not willing to work with them they are going to take it to arbitration? What does this consist of and do I need an attorney or my local prosecutor? How do I file a complaint like some have done with the BBB and Attorney General? I see some have received help from the BBB in reaching an end. I live in Indiana, can anyone help me please. This is the only company out of 7 that I'm being threatened by!!!


What is DFI that you file complaints with? Does anyone know if Indiana allows collection of my PDL if the company is licensed in their state of business, which is Delaware? What exactly is arbitration? Will they take me to court? Someone PLEASE help me! And thanks Cool Abyss for those web sties. I'll start my complaints there.

DFI is Department of Financial Institutions. They govern payday lending in your state. You should call your state DFI and verify their regulations for PDLs to be more comfortable.

Some Illegal PDL companies use the term arbitration in their contract to try and scare you into believing you can be prosecuted under their governing state laws. Example you are a resident of IN, and a PDl says you can prosecuted by Malta governing laws. That is BS you are not a resident of Malta.

Nationwide cash is not licensed in Indiana to lend so therefore they must abide by IN state law. Indiana requires a PDL to be licensed within state to do business. So you can tell them to shove their arbitration where the sun don't shine :lol:

How do I get this mob to stop calling me? I sent a request for proof of loan and how much I had already paid via fax, even sent a copy of Illinois rules and regs showing how they were illegal and got nothing back so I called again and they started getting angry and I told them that I had pd $250 of a $500 loan and would be quite happy to pay back the other $250 and he got lippy saying 'why would we take just that?'. I told him that I did not want another call from them at home or work and he said that because it was in the contract then they had every right to.

When you sent the letter, did you also request them to cease and desist all communications except in writing? Did you file complaints with your state's attorney general's office? I live in Ohio and they were calling me constantly also. Once I filed a complaint with Ohio Attorney General's office the calls stopped.
