My husband had a credit card account assigned to Academy Collection Services. My husband explained to them that he was in the process of filing for bankrputcy, and was advised by his attorney not to make any payments to creditors that was listed in the case. Well, ACS still demanded the payment in full. Since they didn't want to accept what my husband told them, they call our house several times a day. We mostly ignore the calls but sometimes we'll pick up by accident w/o looking at the caller ID. When answering, it's an automated message. Sometimes, there's nothing.

So today I answered a call from them. The woman was rude and didn't want to deal with me. I told her that I was the wife and from now on, they would have to deal with me. My husband isn't really too good with these things. He would actually submit bank info just to get them off the phone. Afterward, I contacted the attorney as well as submit a C&D letter after obtaining fax numbers. I also want to mention that ACS never mailed us any wirtten documentation about this account.


As far as my knowledge goes, the CA needs to send you a debt validation notice within 5 days of initial communication in order to claim the debt as per FDCPA. Moreover, since you are about to file bankruptcy, I think that you should not make any further payments, because if you file bk under CH 7 and your bk gets discharged, you may be exempted from paying the debt.
