LVNV Ruining My Life!

Right after I turned 18 I got a Sears card. Then I got a Sears master card. I paid off the Sears card literally 3 weeks ago. The day I pay the bill to the sheriff I get papers from an officer for notice of rights to have exemptions designated. So I pay off one and they come after me again. I didnt know about debt validation for the first one so I didnt do it. I plan on sending a request out tomorrow for this one. Here is my question, my credit report states that the...

Status: Collection account past due as of June 2008.
Type: Installment (Isnt it supposed to be collections)
Terms: 1 Months (Not month but months)
Monthly Payment: $0 (WHAT?)
Responsibility: Individual
High Balance: N/A

Are their enough violations for me to dispute my credit report? If I send a debt validation request and they take me to court anyway are there enough violations for me to win?

Any help would be greatly appreciated.


Please clarify.

You had two different Sears cards, both which you defaulted on? LVNn seeked jusgement against you and one and therefore you were making payments directly to the sherrif and made each and every payment. Now they are seeking judgement on your for the second account. Is this correct?

I believe, but am not 100% positive, that a collection agency may only seek judgement against you one account at a time. Someone else may be able to confirm this for you.

In the meantime, list the amounts of each debt, date of last payment, what state you live in, etc. The more info you supply here the better someone may be able to help you.

I had two different cards, defaulted on both. I made a one time payment to the sheriff, plus his commission (WTF). Now they are seeking the second. The day I paid the first one I was served again. I am in North Carolina, the debt on the one I need to pay is listed as $2450.00, but the law firm for LVNV says I now owe $3045.04. I havent paid on this card since June of 2006.

Not only that, they expect your parents to pay for you, an adult (I am assuming that you are indeed an adult)? That's pretty presumptuous on their part, especially when you are so broke you have to live at home.

You will likely need an attorney one way or another. It is possible to appear in court pro se, but it is not advisable, especially against slick & corrupt attorneys such as the type LVNV hire.... So sorry to give you bad news. :( But you will likely *need* that attorney eventually....

let me see if I have this right--

youre telling us that you were just served a summons for a second court case, is that correct? If so, sending them a validation letter now would be a waste of time. You really need to speak to a lawyer on this, you arent equipped to handle this without one.

let me see if I can help, I'm in a lawsuit with LVNV and I'm in NC...I can also bet that the attorney's your speaking of are probably Sessoms & Rogers, right?

Ok, first of all, if you have received a Notice of Rights to have exemptions designated, than you have already been sued, ignored the summons (or never received it), and they already have a Judgement against you...if you are paying a sherriff then they are collecting the money that was awarded to them by the court.

When you say you didn't have to go to court for the first one either...what does that mean? Did you ever receive a summons for either of these? If so, did you ignore the summons? or did you sign a consent judgement? Tell me more and then I can help...

The first credit card was sessoms & rogers now it is a scott perle with bernhardt and strawser. I never received a summons for the last one or for this one. I paid a sherriff for the first one, he got a percentage by the way. I never received a summons or signed a consent judgement I just had the letter for exemptions and then the letter to call the sheriff. I have only received an exemptions form so far. I own nothing so there is nothing to exempt. I can't pay them and my parents can't help me with this one, they helped for the last one.

NACA lawyers, in my opinion, "are never taking any new cases"...at least that's how it went when I called around. I am in NC and I called several on that list, so now I'm just handling it myself. Sessoms & Rogers are suing me, on behalf of LVNV...anyway...moving on. There should be a case number on the Right of Expemtions...look them up and make find out how you were served...in both cases...this sounds too weird....never receiving papers?? Call the courts or go down to the clerks office....find out how you were served... you'll want to motion to vacate both of those judgements if you weren't served properly, even if you paid those clowns at S & R already. Now don't pay the other one either until you find out how you were served.

Get back to us, once you find out.

I just wanted to let everyone know because of their help I have raised my credit score 10 points and changed 2 things on it! Sears, the original owner of my credit cards, had my 2 accounts still listed as open. I called and was told they were closed, duh! they sent them to collections. I disputed the claims and now they are listed as closed and my credit score went up 10 points!! I am in the process of disputing the first one since they still claim I havent paid them, hopefully I can fix that one too. I am still trying to fix this second one but now I have high hopes, they arent getting money from me twice no matter what!!
