Wrong name on civil summons

Can they still serve a summons when my name is clearly written wrong on it? They served my husband already so that is how I know it is wrong. I'm in Texas by the way.


if they can't prove who you are..then how are they gonna prove you owe the debt? under the law, isn't it up to the plaintiff to prove you owe the money? if they sue you under a name thats not yours, then they can't even prove who you are..much less you owe the debt..preponderence of the evidence suggests, they infact have nothing on your identity..i'd fight that one with an attorney..

only other advice on this one is they typically file suit shortly nearing the sol on the debt. Hold off on fighting this at ALL until the debt is past SOL in which case they will probably dismiss the case but can not refile (they can, but sol is an automatic win in your corner just by stating it).
