wrong account was attacked..here comes the sharks!

my dad & i share the same name with the exception of jr & sr respectively. anyway, i have a default judgement on cf for a debt and the collection agency just started withdrawing his bank account! i did not no about the judgement until recently, when we as the family, found several nsf charges in my fathers bank account. mind you, he's elderly, and the family has taken care of his financial affairs for a few years. when his checks started to bounce, we called the bank and investigated the situation. now, can we do anything at this point? his account is currently a grand in nsf. this just started happening this month. the debt was paid from his account, but the nsf fees are way high! i have paid my dad back for the debt, but this doens't help with nsf! this involves a nco. thanks..the bank says they can't waive them as they were presented appropriate paperwork to withdraw them and our issues should be directed with ca..


If your dad receives SSI or disability and it is direct deposited into this account, then it is garnishment proof...if this is the case, I would contact the bank and make them aware of it. MAKE THEM STOP IMMEDIATELY. If the garnishment is for you, then they (obviously) shouldn't be taking it from your dad's account. IF however, your name is on the account...that is another matter.

Also, I agree with Nascardevil...find an NACA attorney...if you were not properly served, you may be able to get the judgement thrown out.

I believe that bank needs to review the paperwork they recieved. I believe both the CA and the bank are in error. I would ask to see the paperwork that was sent to the bank. I guarantee it doesn't have your dad's social security number.

I would fight this one. Keep going to the top of the ranks at the bank until you get it resolved.
