Did my ex get me again?

Hello all, any advice would be appreciated. I have $3400 of unpaid medical bills from my ex taking our daughter to the doctor. During our original custody case (01'-02') She took our daughter to the hospital dozens of times and sprang a $6000 bill on me for those charges in court. I had not known or received copies of the bills and the judge decided that I was not liable for those and saw them as her trying to 'bleed' me (judges words, not mine btw). Because of this it is in the custody paperwork that she has to notify me of doctors visits, (she does not) Any medical bills must be given to me within 10 days of her receiving the bills, (she has not) and that we split the unpaid portion of the medical bills. I offered this to the collections department, agreeing to pay half if they ceased collections upon me and was turned down. Today was our second court date on the $3400. She was a no-show for both court dates. I thought it was fairly straight forward that I would be required at most to pay half, but the judgment was that we were BOTH responsible for our daughters bill in full. I can barely make ends meet , but have always paid my child support on time and maintained insurance on my daughter. I cannot afford to pay this and have to set up a payment schedule with in 10 days, or I will have my check garnished. She lives off her boyfriends wages, and has no income other than the child support which cannot be attached. Am I stuck paying the full amount? Do I sue her for half? (I can’t afford legal bills and court fees.)


if you want your credit to reflect a paid status, then you better pay them yourself..later you can sue her for not fullfilling her obligations to the child medically ans seek her half of the debt..try to set up a payment plan is your best advise i can give..it sucks because your score will be effected by this action..

I had a similar situation but not as much money. I live in Illinois and I got divorced I had 3 kids. My youngest son was in the hospital for a long time when he was 3 weeks old and got out after his first b-day. To make a long story short I got divorced when he was 3 years old and shortly afterwards he ended up in the hospital and i went to court and won custody of my youngest son. Well my ex(actually her mother) took my oldest son to a doctor that was not his primary and not on my insurance. They had wanted me to pay since in my papers i was suppose to pay co-pays and keep insurance on my kids. But this I argued about, and the judge made her responsible to pay that bill and I had it put in my papers that if the rules of the insurance wasn't followed then she was responsible. Not that this helps much, but I was just in court and it cost me about $4,000 in legal fees. I would say if you just make an attempt and pay something each month would be cheaper than going to court.
