Electronic signature vs debt validation

So, I'm facing a lawsuit and been reading a lot.

Seems debt validation is a big thing with these types of lawsuits, especially asking the "plaintiff" for proof of signature.

So how does this apply to online actions and electronic signatures?
I can use my credit card at a gas pump by just sliding it through the card reader, same thing at D Donuts, $6 breakfast, no sig required.

I know Dmn well I can't apply for a card online and use it for gas and donuts, having never signed anything by hand, and get out of the DV.

Seems to me this guy suing knows this and has got to use it, he has no case otherwise.

So how does this effect the outcome of debt validation?
It's my word vs their IMO when it comes to this.
So hows it factor into lawsuits, DV, etc.

Heres a real simple write up about the law.
I'd like to assume that this has been discussed here before, but this site doesn't seem to have a search feature that works.


If you apply for a card on-line or over the phone and use it, receive the bill at an address for you, and make payments on the bill that generally is assumed to be proof that you authorized the card.

When Circuit City closed I received a letter from Chase stating that my Circuit City Card would be replaced with Chase card and if I did not accept this I need to CLOSE my account by a certain date.

The CA still has to prove their claim that you owe the money and that they are legally able to collect it.
