I would appreciate any input you may have. I will be brief:

Arrow Financial bought my Providian CC debt, which was $2000 at charge-off. Arrow tried to sue me last year for $3200 but they could not find me so case was dismissed w/o prejudice. I recently rec'd a settlement offer forwarded from prior address..

I want to settle before they attempt to sue me again, but I cannot come up with the money for the next couple of months. Should I risk giving them my current address and submit a letter asking for debt validation?

Any helpful advice would be sincerely appreciated. Thanks.


My advice - stay buried in the sand until you can offer a lump sum payment. They tried (unsuccessfully) to sue you once - they may try again if they can find you. The Lump Sum you offer them doesn't have to be the amount they suggested in their settlement offer - let them chew on it for a couple of months then offer them half of that amount - lump sum, no payments.

GET ALL AGREEMENTS IN WRITING BEFORE SENDING ANY PAYMENTS.

Is there something like "Address Service Requested" printed on the envelope? If so, they have been notified of the new address by the post office.

Certainly, go back and forth with negotiations while you stretch it out. You want to stay in contact with them otherwise they may decide to look up your relatives/work, etc. (if your new address was not forwarded to them) and may certainly try to sue again.

And if it has not been forwarded, even the PO Box is risky as they would still know what county to file in and even if you got a PO Box in another county, you would not be able to wiggle out from a lawsuit by appealing to Improper Service.

In short, cross your fingers and hang on!

having a hard time for Bergner's bonton - capital one - or whoever the f**:evil:k these people are to help me pay my bill off - then capital gives me a wrong number for arrow that is no longer in service - then i go back to capital and these people cannot even speak proper english!!!!!!!**
