800-957-8410 - Does anyone dealt with Capital Management?
Date: Wed, 05/20/2009 - 06:50
I got a call from them yesterday and I haven't received a collection call in about 2 years. This debt has not been paid on since approx Sept of 2005. (JC Penney)
The caller yesterday wanted my bank/rounting information and wanted to post date a withdrawl. The lady said I owed a $1500 and would drop it to $600 and I declined then she said something about $300'ish. I said I would call back today with information for her to pay it.(Obviously I'm not).
Did I just reinstate the SOL on this account?
This company phone calls coming from 866-597-5705 and they want me to call back to 800-957-8410.
Any suggestions on what I should do?
I haven't had any collections calls in about 2 years. They had account information for me for 2 past address' They thought that I lived in CA and I moved from there 2 1/2 years ago.
Any help would be appreciated.
Thanks!
Jaimie

I live in TX now. I can't remember where I originally opened up the account. It might have been CA I'm not sure though. If that matters. Tolled the CA SOL? (reactivated it?)
Thanks

Welcome to Texas! You're now in one of the most debtor friendly states in the country. Tolling does not reset, it freezes it. SOL in CA and TX is 4 years from the date of last payment so you still have a few months remaining regardless. Have you recived anything in writing yet? If not, next time they call, verify your address and inform them they had 5 days from initial contact to mail you details of the account. Tell them you will not do anything without something in writing. End the call. When you recieve their letter respond with a request for validation. A couple links for TX Residents to keep handy:
TX SOS Website for verifying they have a bond posted:

Chapter 392 of the Texas Finance Code gives them 30 days to respond to a DV:
