NCL - violated fair debt, going after 9yr zombie debt, help pls

Need help here before we have to shell out $$ for a lawyer, because we don't know what else to do.

When I was engaged 4 years ago, my husband and I printed off all three copies of my credit report and paid off all open and negative accounts leaving only my student loans, which my current credit report reflects from all agencies.

About 3-4 weeks ago NCL contacted my hubby about a 9 year old debt of mine when I was under my maiden name. They discussed everything with him, pulled my credit report, read him all info, without my permission. Husband works in banking and knows this is illegal. Beyond the fact that this is a 9 year old debt, it is not on the credit report, and the account they are referencing was paid off 4 years ago.

Now they have found my home phone number and are calling multiple times a day which we aren't deleting the messages but are saving should we need to use them as evidence. I am leery to speak with them since I have heard that zombie debt collectors are adept at resetting the clock by getting you to say something you shouldn't.

Does anyone have any suggestions? This is totally horrible what they are doing... I could see if this was 7 years ago and I had crappy credit still, but my credit score and report and glowing now and this just bites.


I actually had something like this happen to me. It was an old Gas bill in mine and ( then ) husbands name. The SOL was up and the 7 years was up as well. Thsi place called non-stop. I told them, over the phone, I wasn't paying it and here's why.They nevre called me or sent anything else through the mail. ALL they want is money.

It doesn't matter anyway, it was PAID off. This is extortion, pure and simple.

I hope you have receipts (or can request a canceled check from your bank) for your payment and (especially) a letter from that creditor thanking you for your payment in Full.

Send them that Cease & Desist letter with a copy of the Paid in Full letter, and if they don't stop, sue them. There's $1000 in it (per the FDCPA) plus possible court costs and attorney fees.

Guest, please think before posting something ridiculous like this. If it was paid OFF 4 years ago, would there still be a balance owed for a CA to be calling about now? Please, let's think about this before we post something like that....

To the OP, I hope you still have receipts for that account being paid in full. If you can get your hands on those, send copies of them to this debt collector in a certified letter and tell them that since this account was obviously paid in full years ago that they no longer have any reason to continue contacting you regarding the matter. Also let them know that should they persist in doing so, you will be happy to sue them for breaking the law and they can pay you for their continued ignorance.
