OK-so I have read on here several times about the threats with being "downloaded", but this is the first time I have actually experienced this myself.

Today (Memorial Day) I was at the store with my daughter and got a call from a restricted number, which I did not answer. Soon I had a voicemail from a guy with such a thick accent I could barely understand him. First, he got my name wrong and then left a rambling message that I or my attorney had to call him back and then ended with "May God help me".

Just for kicks, I called back and was told it was a law firm collecting for "Fast Cash". I told the guy I never had a loan with them and asked for more information-he proceeded to rattle off everything from my address to bank account numbers, etc. I asked again who this was from and the name of his company and he hung up on me. By this time, I was pissed-luckily, I had read enough on here to know that if I do NOT show up in court in California tomorrow (as he said I should) that I will not be arrested. Also, he said the entire conversation was being listened to by the California Supreme Court-really?? on Memorial Day?? Actually he said they were downloading me as we spoke!

Anyway, does anyone know who "Fast Cash" is associated with? I am not worried about his threats but am concerned that they had all of my info. I did have a few loans that I have settled and paid in full and 3 that I am working on now, but nothing with Fast Cash.

BTW-the phone number they used was 408-625-4862. When I called back after he hung up on me-I asked for someone who could speak English and got the same guy-he told me if I was so smart I could figure out what they wanted myself!

Anyone else had any dealings with these guys?

Did you manage to get the name of his collection agency? Many of these outfits buy information from PDLs'. I had a similar experience, a woman called, told me to have my attorney call back and then wished me good luck! I think they all must have similar scripts to read.

By the way, has anyone ever asked these people what is involved in the process when they threaten to "download" you? :)

Wow, being downloaded sounds kinda kinky, lol. Second, after last week's elections in CA, I kinda doubt that the Calif Supreme Court was listening to your call. We have bigger fish to fry over here, trust me.
With the state of our state budget right now, it's a wonder that the entire court hasn't received pink slips themselves. This sounds like a classic scam. And finally, defaulting on a PDL is NOT a criminal offense in California.

OK-so just a quick update. I received another round of calls from these idiots threatening to "download" me. I answered the phone without looking to see it was restricted and he started the whole "downloading" thing. Anyway, I asked repeatedly who they were representing and who they were collecting for-the guy said we are NOT a collection agency, I am an attorney. I was like, really, with what law firm?-then he REALLY got pissed! He told me if I would not verify my information (which I would not) that he did not have to verify anything to me. I told him NEVER call me again (yeah, right) and hung up. Next, I filed a complaint with the California FTC, but have not received a response yet. Anyway, yesterday, the calls started again. No voicemails this time, just several Restricted calls. Has anyone had any luck getting these morons to stop?

Also, I did settle with Payday Yes for less than they said I owed, ( I paid them all of the principal, a fee and returned check charge) but when I called them, they say that the account has not been sold and is showing paid in full with a zero balance. The company that is calling is "ACS" from California and the amount they say is owed is close to what Payday Yes "agreed" to write off. They claim to be collecting for "Fast Cash".

Any ideas??

The only way to get them to stop is to ignore the calls and not answer. Or play hardball with them and answer the calls, but write down a script first, of what you need to say to them. Remind them that you know they are not lawyers, that you are filing complaints with your state, and that you know for a fact that the downloading thing is a lie. Just keep repeating it, over and over, and if they raise their voice, just CALMLY raise yours and keep repeating the same thing over and over - they will eventually hang up.

They will probably call right back, but just keep doing it. Eventually they'll get disgusted with you and stop calling. LOL

Ask 'em to send you something in writing on their law firm letterhead stating that you do in fact owe money, see what they say to that. Or, when they call, tell 'em to hang on a minute and then just set the phone down and walk away for a while. Maybe that will make them stop calling?

I can answer that for you, parachutec - they won't do it. When you ask for ANYTHING in writing, they will refuse. (Been there, done that.) They'll just keep saying they don't have to provide you anything in writing.

My response to that was: "Oh you don't? Ok, well then I'm under no obligation to pay you. That's how this works - you send me paper, I send you money. Got it?"

It usually led to another argument, but it made me feel better. LOL

What works best is to find out if the lender is operating legally in your state. If they're not, get the code number of the law that indicates they have to be licensed in your state and throw that at them every chance you get, accompanied by statements that you KNOW they are not licensed and are operating illegally - and follow it up with a threat to have THEM downloaded if they continue harrassing you.

SueBeeHoney70, I know from past experience that my asking for a letter won't make a difference; but it DOES throw them off their script and they get all flustered, esp. when they discover that they're talking to someone who isn't buying their "we will download you" threats! I stay very calm and cool, "oh, you say you ARE legal in my State but you're unwilling to send me something in writing to that effect? How interesting?" I keep going in my most "see here, my good man" tone of voice; they start blustering, it's really rather pathetic. :)
