So on thursday I have a court hearing from a company called midland funding. they are sueing me for a credit card i got when i was 19. The amount i was allowed was only 300. now they want to sue me for almost 5500. Unfortunatly, I'm now a single mom to a 3 year old. i live in subsodized housing. i get food stamps and wic and health insurance through medicad/dr. dyno. I was told that my income is protected by the state becuase of my state assistance. What can I expect to happen. I was told that I didn't have to agree to any judgement to pay anything. HELP. I'm scared! How long do these usually take??


Firstly, you should be present in the court on the hearing date, else the creditor may bring a default judgment against you.
Secondly, you should check whether the SOL on the debt has expired or not before you visit the court. If the SOL has expired, you are not legally liable to pay back the debt and you can produce this fact before the court to avoid judgment.
Thirdly, although it is true that your ss benefit can never be garnished, you should avoid judgment as it affects your credit score badly.
Can you please tell us the date of your last payment and the state you live in?
