I respect a consumer who researches the services to which he/she uses. With that being said when you applied for and agreed to the terms of the loan it would have behooved you to read the complete contract you were agreeing to. You are a citizen of the state of Texas, however the contract was not made in the state of Texas. The contract was completed via the World Wide Web; the governing law (clearly outlined in your contract) that you agreed to by your legal e-signature is based on our government laws. When you spoke with Shelly on 04/09/2009 at 10:43 am CST, she clearly outlined how the loan works and what the finance charges were; yet you still accepted the loan.
With all the information at hand I am still willing to work out arrangements for the principal that is still owed on your account. We will cease debiting the finance charges of $150, however the account will not be marked “Paid In Full†until the principal amount of $500.00 has been satisfied. You may contact our offices 8am-5:00pm CST Monday-Friday. Our toll free phone # is 1-866-376-5077. You must contact our Customer Service Department as soon as possible. If no contact is made within a reasonable time the account will be sent to a third party collection agency.
If you have any questions do not hesitate to call or email.
Thank you,
Customer Service

I know in the loan documents that you agreed upon explained the terms as well as explained that you will be waiving your state laws and agree with our state laws, and I also show that you have had several good loans with VC Funding and paid them all back with in the loan terms that were agreed upon, but if your even needing brake that balance into a couple payments I will be happy to take in consideration that you have had loans with us and help you set up arrangements to pay it off.

Since the Hodes brothers run VC Funding out of Kansas City, Missouri maybe they'd like to try on Missouri law. It's a lot less forgiving of the $30 per $100 and unlimited refinances they do than Texas law is . . .
