I received a letter delivered by a random man at an address I don't even live at, but have my mail delivered there. It didn't come in an envelope and i didn't sign a thing. It's a citation for small claims court and apparently I'm being sued by midland funding.
Here's the catch, it was issued January 21, 2009 and says that "if this citation is not served withing ninety days after the date of issuance, it shall be returned unserved."
Well it's been over 120 days since it was issued. Does this matter?
All of it seems very fishy to me.


I live in Texas and it was hand delivered to my girlfriends house (i was there at the time) and it was by a random guy, no constable, and not by mail. Nothing to sign either.

Probably a special process server. Someone OK'd by the court to serve the function of serving process. If it was delivered in January and you have done nothing about it, then I would call court immediately and find out what is going on but don't be shocked if there is already a judgment against you.

It was delivered Yesterday, it says it was issued in january though. Issued january 21, 2009.
