Help needed in California
Date: Sun, 05/31/2009 - 12:30
Hello everyone:
This forum is an incredible source of information. I am in the process of dealing with several payday companies. I believe they are all illegal and I have overpaid some of them.
I would love to get help/advice with each company. Below are details about how much I've borrowed, paid back, etc. I also have a couple of questions:
1. When determining if I have overpaid a company, do I only look at the most recent loan? For example, let's say I took out a $300 loan from an illegal company, it rolled over a couple of times at $90 each, then paid it off at $390. So I paid $570 on a $300 loan. Then I took out another $300, it rolled over once at $90, then defaulted. Would I owe this illegal company $210 (principal minus $90 paid) or do I combine all the loans I've taken and all the payments made and determine that I have overpaid them over the course of both loans? This might be confusing but hopefully it makes sense enough for someone to answer.
2. I believe the following companies are illegal (I'm in California). Can someone please confirm?
Onestepcash:
Borrowed $400. Paid $285 before loan defaulted. They offered to "settle" for $640 at $80 per month via Moneygram. I sent one payment of $80 on 5/15, so I've now paid $365. I believe I owe them $35 and no more. I've also overpaid them on previous loans, so I'm not even sure I owe the $35 and would like to go after them for a refund from my overall overpayment to them over a series of loans.
1800899cash:
This is a "installment loan" but I think just a payday lender in different clothes. I don't think they are licensed in CA. Anyone have experience with them? I borrowed $600 and paid $137.15 before defaulting. I've also overpaid on previous loans.
Eastsidelenders:
Borrowed $300 and paid $135 before defaulting. I believe I owe $165.
JD Marketing:
Borrowed $300 and haven't paid anything. I believe I owe $300.
Inmyaccount.com
Borrowed $200 and haven't paid anything. I believe I owe $200.
Paydayloanyes:
I borrowed $300 and overpaid before defaulting. They wanted $360 to settle. Two payments of $180. I paid one payment and another one is due next week. I read about their awful tactics and wanted to get them out of my hair. But I'm now considering not paying the final $180 and either insisting they send a PIF or go after them for a refund.
I really appreciate any help people can give. I am going to use the excellent sample letters and write to all companies.

Is anyone able to help? Am I on the right track? I'm particularly interested if anyone has experience with 1800899cash and if they are indeed illegal. Thanks!
jameshess I am not understanding what your question is exactly.
jameshess I am not understanding what your question is exactly. Can you clarify? You said you've paid over and over but you never took a loan? They never made any deposit in your account? If they have been taking money out of your account but never made a deposit and you don't owe them anything your bank should be able to help you with this. What company exactly are you referring to that doing this?
