I recently entered the realm of payday loans and have found myself buried! I'm stressed and scared and don't really know what to do. I live in Texas and have taken out 5 or 6 payday loans and I just can't pay the extension fees any more. I am not in default yet, but as of Friday the 5th I will be. I closed my bank account and I'm afraid that it is the wrong thing to do. The lenders I can remember off the top of my head are---
CashNetUSA---400.00--pd. approx. 600.00--owe 250.96
Soloman Financial--300--pd. approx. 240.00---owe 420.00
Pay1Day---300.00---paid approx. 180.00---owe 390.00
GoodTimesCash(?)---200.00---pd. 120.00---owe 260.00
All of these are internet sites---seems like there are more--can't remember right now. Any help would be SO appreciated!

No no, closing your bank account was the right thing to do, it doesn't mean you won't pay them off, it just means you needed to get control of your finances again. :) You can search at the link below to see if any of yours are CSO's (Credit Service Organizations), I happen to know CashNetUSA is a CSO, which means you will need to make payment arrangements with them. If you haven't defaulted yet you are eligible for the EPP (Extended payment plan), just request it.

I always get nervous when I see those words "legal" and "illegal" in the threads. "Licensed" or "Unlicensed" is a statement of fact. But whether a consumer contract with an unlicensed lender is enforceable or not is a legal opinion regarding state laws. Only an attorney licensed in that state should be giving that answer.

Having said that, I don't think Shazzers was giving legal advice. Just making a point about how loaded certain words that we all use as shorthand in our posts can be.

As far as tdodie's problems go. Getting out of the debt is gonna require self-help. In Texas, whether or not someone is registered as a CSO normally only affects whether the lender can/will take legal action. The Texas Consumer Credit Commission only deals with registered CSO's and has no authority to regulate unregistered ones. The Texas AG has that authority but hasn't been real aggressive with internet lenders to date.

You didn't give any of these guys a check, so go ahead and close the account. Avoid collections calls as much as you can. They all use dialer programs that determine who the collectors will call. If they can't reach you, the dialer stops putting your number in the queue, or at least does it less frequently. And if collectors do get a hold of you and get abusive, report that to the AG. The Texas AG DOES have a track record of going after collection abuses and Texas has very good laws that protect you ... no wage garnishment, no distinction between 1st and 3rd party calls, etc.
