Hello. Live in Florida. Owe Chase 22k. I haven't made a payment in six months. I never received 1 phone call from them. Sunday my name showed up in our local paper as Chase vs. Me. I did offer Chase a settlement several months ago but received no response. Not sure where to go from here. Several other companies, including Advanta, have already settled with me. I still owe Chase and Elan. Any advice would be appreciated.


Have you been served yet? If not you should be very soon by a rep from the county court where you live! Make sure you show up. There will be a mediator there that will help you work out payment arrangements! Bad news is you will have to pay their legal expenses on top of what you owe. Can you get an attorney? If so do it now not after the fact! Better to pay your lawyer than theirs! He or she can force a settlement in most cases.

There are extremely rare posts on this board where my insides scream for me to plug a service. This is one of them. Only because there is effective assistance to be had by select 3rd parties with established relations relative to your predicament.
Alas, no can do.
Florida, California & Texas residents are seeing this more than other states (barely past discharge date with suit filed by Chase legal).
Depending on what you were prepared to fund a settlement with, it will still be very doable for you.
Depending on what your hardships are and how skilled of a communicator you are, you can still be successful with your original intent.
I suggest not giving into a moment of defeatism and go for the results you wanted in the first place. Now though, you will be doing it with Chase legal.

I would try having it vacated due to improper service (if you didn't see it in the paper, how would you know?) because the process server didn't deliver it properly. See Defense #1 on this link:

(The sites I put here are for New York and are just an example. Your state may vary in its regulations and procedures.)

I hope this works out for you. It's terrible that you have gone so far into settlement and would have to end up filing bankruptcy anyway.

See "http://www.nedap.org/hotline/court.html" for the normal process of Civil court. You can also try for a Settlement in court:
"http://www.nedap.org/hotline/settle.html"
This is a better option because you want to try and avoid a judgment if at all possible.

Check out all your options first.
