Received letter from Stellar/crown assett management 4/10/09 too late?

I need to validate the debt but this went to my parent's mail and my mom just gave it to me. So 30 days is going, going gone to validate and I think it myight be my ex-husband's.

What are next steps I should take or do I just need to pucker up and set up payment plan to pay off to avoid judgment?

I live in Texas....OC says Household credit but I think it might have been Orchard Bank? 675 is approx debt but will settle for about 275.


You should send the DV letter within 30 days of receipt of the letter from CA. Once you get the debt validated, you can go for a payment plan to avoid judgment. However, before you start paying off the debt, you should check whether the SOL has expired or not. If it has expired, there is no need to repay the debt and the creditor cannot sue you for judgment.

Fortunately you're in Texas so you can DV at any time. They must respond w/in 30 days. See Chapter 392 of the TX Finance Code:

Get a credit report and send a Dispute through the Credit Reporting Agencies on whose report the offending mark is.

I doubt they will go to court over such a small amount, but it is possible.

Orchard Bank & Household are both part of HSBC.

Although I must say $275 sounds like a good settlement - if that is in writing, I would just pay it and move on.
