Collection Agency Calling - Help!!

So back in March, my husband got a call from NCO Financial telling him he owed money on a debt we were told we finished paying in 2006. NCO told us that we simply just "stopped paying" in February 2006. We actually paid until July of 2006 so NCO doesn't even have the correct information.

Back in July 2006, we were informed that the account was paid off and we no longer owed payments (we were on a payment plan). Suddenly, three years later, we get a call saying it's overdue and has accrued over $8,000 in interest and penalties, etc. This is the FIRST time this company has contacted us in 3 years. While we have moved once, our telephone number (the same one they called us on) has been the same for the last 6 years.

First they claimed we had an excellent payment history. Then when I pressed harder for a reason why I'm being called now, the man put me on hold to find more information and simply transferred me to a brand new agent. That agent told me that the collection agency had only recently gotten the account. Then told me they've never received a payment. Then when I informed her that the previous man told me we had an excellent payment history, she put me on hold and came back and said yes...you did until you stopped paying. I told her we stopped paying because we didn't owe anymore, per her collection agency despite the fact that she is telling me the agency JUST got the account. It went 'round and 'round.

I wish I could say we kept stellar records back then and still have everything but I can't. We keep great records now, but that doesn't help us any. I can prove we made payments to them but I can't prove that they said it was paid off.

It appears that the SOL will run as of August. They are not and have not ever reported on my husband's credit. The original creditor has not reported either.

We are getting 6-8 calls a day from them. They even called Saturday morning at 6:15 a.m. We told them what time it was and they simply hung up.

Does anyone have any advice? I would love some input!!! Thanks.


Without proof of payment to the collection agency in 2006 this is going to be a hard one. You could start with filing complaints with the Atty General and FTC but even they might ask you to furnish paperwork. Sorry to say it but you are going to have to find anything from 2006 related to this.

doesn't matter.it is up to the CA to prove they owe,not vice versa.send the bottomfeeder a DV letter.send it certified mail return receipt.
