Asset Acceptance.....What do I do now?
Date: Thu, 12/29/2005 - 16:25
As per what I saw here in the forums I sent a letter to them certified mail asking for validation of this debt as this was something from my previous marriage and lord only knows where the receipts are from getting it paid etc.
The letter was sent on Nov 23, 2005 and which was signed for on Nov 29, 2005. So my questions are, once the 30 day deadline expires that I gave them in my letter to respond comes and goes what do I do to make sure that they did as I asked which as stated in the letter is:
Quote:
If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately. |
Also is the 30 days that I gave them "business days" or 30 monthly days?
Thanks in advance.

Hi criley
Welcome to the forums.
Be confirmed that this debt is out of the statute of limitation in your state. Based on the date of last activity in your account, you can't be forced into any legal actions and you won't have to pay the debt.
Once the company has sent you the details of this debt in writing, place it on dispute putting your side of the story. Check your credit report and see if they have reported any derogatory remark in it. They will have to remove it since they don't have any legitimate reason for it.
If Asset doesn't reply within 30 days and any negative remark is entered in your file, show your letters to the CRA highlighting the items. They will verify it with the collection agency and remove the remarks from your file. A free copy of your CR will be sent to your mailing address.
You don't need to worry as long as the company has not hit your file negatively. But make sure that you have replied back to their letter with your dispute. If they intend to take any legal actions, you should have a copy of your dispute. Be sure to send all your letters through certified mail with return receipt requested. This way, you will have proof of all the actions taken towards this account. You can hire an attorney also if you are not able to take care of this matter individually.

They are at it again.......
I sent a letter to Asset Acceptance requesting Validation on Nov 23rd 2005. Later in the day on Nov 23rd I received another mailing Stating only whom the original debt was supposedly with but no other information. I have not heard anything else until.....
Today I received yet another letter from them requesting payment. Still no additonal information or details about this debt that if I believe them is from a power company from back in '91 that was sold to a collection agency in '92.
What do I need to do to stop these letters and get this matter closed. Nothing is appearing on my credit report but I want to get this matter resolved..
Thanks Again.

It seems they are still trying to collect it. Simply send them a cease and desist letter mentioning the fact that SOL for the said account has expired and they should stop contacting you. Make it certified wit return receipt requested.
