I told the guy on the phone that I dispute the debt completely, the address they had for a service address is one that I never resided at, got my mail delivered to or anything else. But something tells me that me disputing it wont get these guys off my back. Anyone got an answer on the SOL?
What is the name of the company of the debt collector?

at this point I would rather not say, I know they monitor this place. I will say that they have one of the worst reputations in debt collections, and I have already checked up on them. Thats why I am trying to get as much info as I can--because I dont believe that they will stop trying to collect simply because I have never lived at that address.
I also learned that they now own this debt, they bought it from the last creditor, whoever that was I have no idea as this is the first I have ever heard of this debt. The big thing right now is that I am trying to find out the statute of limitations that applies, since it is a landline phone bill I dont know if Louisiana adopted the SOL portion of the UCC or not. My state's website isnt much help either.

Well, first things first...disputing the debt via phone is not effective...you must create a file (or paper trail).
Send them a DV letter disputing the debt...MAKE SURE YOU SEND IT CMRRR...if they don't respond, then they can't proceed with collection activity.
Just a side note...I wouldn't be concerned with saying who the CA is since you are posting as a guest, have given no personal info and are general in your questions or comments...there is no way they would know that it was you!!

I am going to throw a guess in that it is AFNI. I have a bill from there for a landline I had years ago. In my state the sol does come in play. It is 6 years + 180 days. But that is in WI.
But yes you need to send them a letter disputing the debt. There are sample letters that you can use. But make sure you send the letter within 30 days of getting your first letter from the CA. Then check you credit report. They will have this reported on there. And after you get the green card back in the mail then check to make sure that they report that the account is being disputed on your credit report. You can also dispute the entry with the CRA's.

well, it's portfolio...and if they report on my credit files then they are already in big trouble, since I have them on tape telling me that the account went delinquent in 2001, that automatically shows that it is past the applicable reporting time per the FCRA.
But I really need to find out about this SOL issue. Anyone have the answer here? my state's website doesnt give very much info at all.

thanks nascar!
It isnt that I doubt you, but when I speak to them again I would like to be able to show where I got that from. Is there a link to where you found it? My state's SOS office was not even helpful over the phone...thanks again!
