Resubmitting check by ach to recover fees

I reside in Washington state. I had a payday loan that was paid in full 6 weeks ago to Advance America. This past weekend they resubmitted the same check via ach with the same check number for the full amount of $750.00 and my bank...Chase processed it. I called their district office and was first told that the check bounced six weeks ago then the next day that they submitted it to collect a $25 nsf fee. The district manager I spoke with said it was "company policy" and they would refund the $725 in 7 to 10 days once they were sure it had cleared. After screeming my head off at them they have agreed to refund the money tomorrow if I go to the office. This really sounds illegal to me. Anyone else ever hear of this? I'm going to contact the state attorney general and possibly file suit if it may help others.


Thanks for the replys. I actually did contact my bank and believe it or not all they would do is give me a fax number for the company to fax in a statement saying they were reversing the charge so it would go through faster to avoid additional overdraft charges since the $795 did put me in overdraft.

I would call the Corp Office and explain your situation there. It sounds to me like it was either a mistake on thier part and someone is trying to justify it or Someone at the store level is trying to pull a "fast one". I would bet that AA is not in business to steal money from customers considering they are a publicly traded company and have to open thier books to outside regulators and it would be very difficult to hide "double debiting" on a mass scale.

FYI...
From my side of the fence, the first thing that I would look at is employee theft. The little information that is provided tells me that the account was not originally PIF and was later submitted electronically. As an owner, I would want to know where the original payment (cash I assume) went!!

Was this a LOC of a regular PDL loan? I am assuming you made the full $750 payment by check. I am in VA, and the AA here gives/mails you a PIF receipt to the customer once your PDL have been paid in full. I agree with PDLOwner this possibly seems to be something more in depth with the employee. If your check 6 wks earlier was returned a resubmitted the next day and cleared then the payment is done! Seems like failure on their part to document the transaction properly :x

I am confused in this explanation alltogether. So they are denying your prior check (6 wks earlier) cleared? Like Soaplady stated I would be disputing the ach with my bank ASAP being they resubmitted the $750 payment 3x now.

At first (Monday) the district manager said that the only way they could resubmit the check was if the earlier one had not cleared. I explained that it had cleared. When I spoke with her on Wednesday she changed the story and said that she could no verify that they check had cleared six weeks earlier and that the store resubmitted the exact same check via ach for the full amount to recover a $25 fee I supossedly owed them from six months ago and that they would refund me the difference once that check cleared. She called me back last evening after I told her that was unacceptable and I'm heading down there this afternoon (to a different location) to have them refund the money. I'll follow up with my bank to make sure they cannot continue to do this.
