bank questions-need advice

I also have two loans through the bank which are automatically taken out of my checking account. What I would like to know is why they continue to take out a loan payment when they know my account is overdrawn? :?: They have tried to take out one loan payment for about $25 four times now and each time it is not honored and each time they charge me another $28. I'm sorry but this sounds like a scam to me. The bank has been very uncooperative with me in dealing with this whole mess. :evil:
Is there someone that is knowledgable about banks that can shed some light on this for me? Do I have any rights? :roll: Thanks!

Can you provide some more detail on your dealings with your bank? You will probably need to push harder, get past the front line customer service people and get in to some higher up customer service/ Customer relations people who have ability and authority to research and make such decisions. I had a situation with a large national Bank a few years ago, and was initially met with a tough luck attitude and even referred to a lawyer for collections. I persevered and was eventually refunded more than I though I was due, and even given a $100 Gift Check for my inconvenience.. it took about 4 months and lots of calls back and forth to get them to resolve the problem, but once you get away from the front line people, they tend to listen a little more and be more willing to correct problems or to work with you on a resolution.

Was told I could only stop payment on a specific amount. I don't know the specific amount because they KEEP CHANGING IT! :shock:

The loan payment I stopped has now tried to come out of my account again. Was told by above said manager I was given wrong information. I told her I had spoken to loan officer so and so. Sorry too bad. cha-ching another $28. The other loan has tried to come out for the 5th time now. Sorry, but that's automatic and can't be stopped. cha-ching, another $28.

Then you probably need to escalate to a higher level (out side the branch most likely), a Regional Manager, or even the Consumer Relations department. Is the payment different every time?? Can you kinda figure out how much the next payment may try to be for ?? Try placing a stop order that way.
Be aware that even with a stop order the payday loan place may still continue to try and re-deposit the checks, possibily accruing additional fees. If escalating to another level doesnt help, you may need to consult an attorney to talk to these people and arrive at a resolution for you.

This is a county bank with only 4 branches. I emailed a complaint to the CFO. He was the complaint contact on the Ohio Financial Institutions website. I wanted to make sure he got it personally. Haven't gotten a response yet. Sent it Monday. Really don't expect a response.

Did you do the online complaint form with the attorney general/consumer protection office? I went round and round with the division of financial institutions last week. It was really frustrating. If you do the complaint with the attorney general's office it will get to the right department and you will receive an automatic reply with contact information. I filed against one payday loan company last Wednesday evening and it was resolved yesterday. PM me if you have anymore questions.

Tried this and could not get by the front line people. They have now agreed to consolidate my overdrafts and overdraft protection loan into my truck loan for one monthly payment and finally close my checking account, now that I think the payday people are done debiting my account I must add.
The county in which I live is very rural. If you aren't originally from here, they tend to be very cold and rude.

They agreed to consolidate my two loans and overdraft fees into one loan on 1/11. I was told the payment would be $229, was $199. Couldn't get in to sign the papers until 1/17 due to the holiday and bank manager being off.
On 1/3 I had gone in and signed a paper disconnecting the loan payment from my checking account. On 1/13 they charged me $84 more in overdraft fees. I didn't realize it until I went in to sign the papers and the overdraft on my account had gone from $611 to $695. I asked why. More overdraft fees I was told, wasn't told what for. Signed the papers. Loan payment now $235. Had to practically beg for them to give me a copy of my loan papers.
Got home and in the mail was a notice that, on 1/13, I was charged $229(my loan payment?) three times which, of course, did not go through and caused overdraft fees. As far as I'm concerned, this is blatant fee padding. Should I just let it go since I've already signed the loan papers? I already complained to the CFO which I think got me the consolidation, although I got no response from him. This just burns me. :evil:

If not, you can always call the consumer protection office or division of financial institutions to see what else you can do. You might want to do that before you file a formal complaint.
