Whoaaa, that's rediculous to threaten you with arrest for defaulting on a loan? Owing a debt is a civil matter not a criminal one. Commonwealth Financial should be arrested for making false threats against you!

I'm in the same boat with a place called HZB Financial. They threatened check fraud. I called CashNet (who is legit) and got the details of my defaulted loan. They were VERY helpful. They sold it and gave me some information about what happens next. If CashNet works via ACH, can they still sue someone for check fraud? I guess my other question is if Texas has a limit of $500 total from any one pdl provider, can I offer them $500 and end this? Thanks!

The PDL accepts check written for these types of loans knowing that they are "bad". As a former civillian contractor for a District Attorneys office, I can say that you cannot be prosecuted for this type of check. The same is true of ACH debits if you close your account.

I called HZB this morning and told "Mrs Hall" that they lied to me, that I'd been in touch with CashNet USA and they do NOT own the loan and that I had not received any written corresponce from HZB. She left me a rather nasty message stating that they had lied about nothing, that THEY send me information, I don't request from them (!!!), and that she was escalating the "check fraud" thing. She also stated that they had sent out something on 5/31/09. I haven't received anything from them. I'd never heard of them before her call.
Oh and she said that HZB is a legitamate company. Any truth to anything she said?

HZB Financial
This company is a collection company but in no means do they follow the FDCPA . They can be sued as long as you keep records of dates , who you talked to and all phone calls from them. They are harrassing people into paying the debt they say you owe. That is not allowed. Go to the FTC website and read your rights.
HZB Threats
I got a call from HZB today. She asked me if I was ready to pay. I told her that the last time we spoke that I wanted validation of the debt. She told me they sent me letters in Jan, Fen and Aug of this year. I told her I have not gotton anything! I have not. She then told me that she will recommend legal action. I asked if this was an attempt to collect a debt. She told me no! She is an investigator in the legal side of HZB. I recorded the call because it started to get heated! She told me that I was a career debtor and was only using stall tactics!! Is this legal?

Not that I've ever been arrested or had problems with the law, but common sense tells me that someone isn't going to call you in advance to warn you they are getting ready to arrest or take a warrant out for you - these places are crazy!!!!!

Common sense also dictates that if you had sent someone something over several times and they hadn't gotten it, wouldn't you confirm the address with them? And why hadn't they sent it certified? It really sounds like a company trying to shake down and scare a poor consumer...
