NO, No, and No. They can attempt to sue you if they want. It will end up costing them their business. Here is what I have noticed with most Illegal lenders I have came across.
#1 No License registered in most states.
#2 No Legal recourse in any court of law no matter what they threaten. Not even arrest for debts are civil matters.
#3 Contract null and void if not licensed in your state or any state according to many state Attorney General Offices.
#4 Sueing you will cost them more in fees than the original loan amount most likely.

Keep in mind to the company must hold a valid license in the U.S. according to most state laws. So if you are referring to Legal/Licensed companies then yes they can sue.
From my understanding, arbitration by an off shore lender holds no grounds if they are unlicensed to lend to U.S. citizens. I have been threatened with arbitration of Malta, Ireland, Bahamas, etc. This happened because I took a loan over the internet and was told I am subjected to prosecution and governing laws of their country. That is bogus and my lawyer laughed all the way to the bank.

All our bank could give us was a 1-866 number for this company and our bank at the time refused to let us close our account. There was another one taking money out of our account at the same time as CMG, they are Debit DR/Magnum Z, our bank could not give us any info on them either except a 800 number. When we filed BK in April 2009, i had to dig to find information on these companies to give my Attorney the information. :)

I have one I am now questioning as there automated phone system just happen to be not working all week and I just got through this evening to tell them I wanted to make an extra payment on my loan to pay it down and they tried to deny me and when I requested a supervisor they denied me that then the foreign lady proceeded to read off script over and over like a computerized robot till I threaten to close my bank account and deny them anymore payments then she said oh wait we can schedule to take a new payment so I am questioning as I questioned her if they were legally licensed to operate in my state and she refused to answer.
