Emerald Marketing, Nasty Creditor

Hi, I had received a payday loan with Emerald Marketing back in 2006. The amount borrowed was 300.00. I think I had 10 ACH withdrawls in the amount of 900.00. I live in Maine. I actually moved out of the area, closed my account, and really heard nothing more from them. Yesterday, I receive this call at my place of employment, from a creditor who refused to give me any information of any kind other than the loan and my old bank acct. info. I asked her to mail me the information so that I may verify that it was legitimate. She then told me if I didn't pay 300.00 by the end of June they would contact my HR department and have my wages garnished. Needless-to-say, I was a bit panicked for a bit until I started doing some online research. Now I am angry. My problem is, all that information for that company and the loan acct numbers was in an old computer of mine that has since crashed. Does anyone have any advice as to how to contact them without my info as I have since found out that they have no license to give loans in the state of Maine. I think I had more than paid them their money. Also, in dealing with this nasty creditor who won't give me any information, how should I deal with her?? I am pretty sure she called again this morning and left a message on my voice mail and I want to be prepared for her the next time she calls. I have read and learned a lot on the posts here and I want to thank you in advance. I do know about sending the letters etc, but difficult without any information.


They can't garnish your wages without a court order, but, if you signed a wage assignment at the time you obtained the loan they can attach your wages. The good news is you can revoke the wage assignment at any time, send them an email revoking it, print out a copy and give it to your payroll dept., tell your payroll dept there has been some illegal activity by an illegal lender from years ago and you need to protect yourself just in case, then you should file a complaint with your AG and the FTC.

Thanks for the info. Well it's their "creditor" who is supposedly contacting me and refuses to provide me with any info. My guess is that they don't have any and certainly don't have a court order. They were going to "contact my HR department as soon as they hung up with me". I'm certain, they would have let me know about it. So as long as I contact Emerald and not the so called "creditor" I should have my basis covered? I do intend on filing the complaints. They also told me that they were going to charge me with "Internet Fraud". That one, I actually laughed at. :) And really, if they are illegal to loan money in the state of Maine, how on earth could they obtain a court order?
