Can you tell us how much is your debt with Express Check Advance and when did you make the last payment towards the debt?
I think that you should first try to negotiate with the creditor to settle the debt for less and them come to a payment plan to pay them off. This is because, since they are payday loans, the outstanding debt would be very high as compared to the principle amount, which may be difficult for you to pay.

I'd also contact CFSA and see what they can do.. sounds like they are refusing to let you set up a payment plan, which you have every right to do.

Thr original loan was 365,95. I am sure they added at least a 30 dollar bounced check charge. I have not made a payment for awhile because I was working with progressive. I decided to cancel progressive a couple of weeks ago

I think that you should ask them for debt validation to check your current outstanding balance, including interest and other finance charges. If the outstanding balance is very high, I think you should negotiate for settlement, else you may pay off the debt in full.

Hi Guys,
A couple of things to think about, You need to work out a payment plan and you need to keep in contact with the employees for the company you are dealing with. If you do not like to deal with the people at the storefront, contact the regional manager or the corporate office and deal with them. That is what I did. I contacted the regional manager and corporate and they worked with me within the laws of my state. If you do not want to call the storefront to get that information, contact another one of their stores and ask for the info. Do log all your conversations with them, date, time and who you talked to as well as a description of the conversation, do send letters certified or atleast signature required, which is cheaper, so in case you have to go to court, you can show you were trying to work out something with them.
You also need to check the laws in your state. Just because they are a member of CFSA, does not mean your state laws will allow for a payment plan and state law over rides CFSA membership. For example, I went into one of my storefronts (they too were members of CFSA) and asked for the CFSA payment plan. They told me they do not do that....I was like what???? But according to the CFSA website and everything I read on here you have to. I called CFSA and they told me that my state only allowed for the amount owed to be broken up into two payments and that the state law is what the store and CFSA had to go by. Remember too that CFSA payment plan allows for the amount owed to be broken up into 4 payments so carefully check your budget and be sure you can do this.

The bottom line is that you need to contact the Corp Office and explain your situation. Do not deal with the store SInce you have already lost positive communication with them by not returning calls. When you explain the situation, it makes sense, but by not calling you make them assume that you are hiding.
As for the courts, they do not generally care if you have been trying to pay. This is an issue of do you owe the money or not. Yes, you owe it and the courts will decide in the PDL's favor. From there you can set up court appointed payments that you need to stick to. If you fail on the payment side, the next step is a garnishment, which costs more money. Save youself alot of money and "grief" and call to make arrangements.
