I received a phone call from Lilly @ Thompson & Thompson Attorneys (so they claim). She told me I have a "pending summons" that is being sent to my home if I do not contact them today. First - does anyone know if this company is for real? Second - can they issue a "pending summons" whatever that might mean?

Payday Loan Yes has in house collections for up to 180 days. After that they are packaged up and sold to a collection agency for about .10?? on the dollar.

However, since they are the original creditor they can technically sue you, obtain a judgment, and garnish your wages or levy your bank accounts, based on your states laws.

Why would you ever take a loan with them in the first place?

It sounds like they have already violated some laws, try to tape there conversations by putting your cellphone on speaker and holding a handheld tape recorder call 215-745-9800 or file a claim online, this is a top notch law firm in philadelphia that specializes in FDCPA violations, they have done alot for me when i felt i had no where to turn when i did not know my rights,if they cannot help you i think they can send you to someone else that can good luck, you are going to be okay,we all make mistakes,it is how we learn from them that is the most important thing...

nola504 i had a loan with VIP and I am not sure if they are legal anywhere but it might depend on your state's laws (i am not familiar with TX) A sheriff does serve lawsuit papers at peoples' jobs but this is only if it is a legal loan. But even than all they do is drop something off, they will not take you to jail or anything so no worries there.
